The ninth circuit court has maintained a ban on sending state troops in the Oregon city, after a recent legal decision.

Appeals Court Agrees to Rehear Legal Matter

The federal appeals court decided on Tuesday that it would reexamine the legal dispute concerning the executive power with an expanded panel of eleven justices. The court also vacated a earlier ruling from a smaller judicial group that had supported the administration.

Ongoing Dispute Over Military Presence

This order represents the most recent turn in a protracted legal battle over whether the former president has the legal right and justification to send state military units in Portland. Approximately two hundred troops have been in limbo since late September when the deployment effort was initiated in due to months of protests.

Differing Viewpoints

The federal government has claimed that federal officials at the immigration center in the southern part of the city were under attack, while city and state officials maintain that local officers have control of the circumstances.

Contrary to descriptions of Portland as a conflict zone, residents have been posting videos of scenic paths and a vibrant culinary culture, and planning events such as an Emergency Naked Bike Ride against the “militarization of our city”.

Recent Legal Actions

The appeals court decision came after a US district judge in Portland enacted two temporary restraining orders this month – one preventing the federal control of the state troops, and another prohibiting the use of any national guard troops in Oregon, after attempts to circumvent the initial injunction by calling up troops from California.

On the previous day, the appeals court had temporarily suspended the initial decision – allowing command of state troops – but the subsequent injunction stayed effective, preventing the actual deployment of the troops.

Full Panel Consideration

The Tuesday decision means the matter will be heard “en banc” – with all decisions under review simultaneously – by a group of eleven justices.

“This decision demonstrates that facts are important and that the courts are working to hold this administration accountable. The founding document restricts the executive authority, and Oregon’s communities cannot be treated as a testing site for expansive government power,” stated the state attorney general in a official comment.

“The judicial body is sending a clear message: the executive leader cannot dispatch the military into US cities without cause. We will continue defending Oregon’s laws, values, and sovereignty as this legal proceeding moves forward and our fight continues in the judicial system.”
